By confirming the order, the following conditions are automatically considered confirmed:
Art. 1 OBJECT
These general conditions of sale govern the sale of products marketed by Green Soul Cosmetics, with registered office at Via Gerolamo Fantoni 1, 25087 Salò (BS), via the website www.greensoulcosmetics.com to consumer users.
The General Conditions of Sale are effective from the date of acceptance by the customer on the site, which constitutes acceptance pursuant to art. 1341 of the Civil Code.
Green Soul Cosmetics reserves the right to modify these general conditions of sale at any time by posting them on the website.
Note on INCI (ingredient list): The ingredient list (INCI) on the website is for illustrative purposes only and may vary. Customers are therefore advised to always refer to the actual ingredient list on the individual product packaging, which represents the official and up-to-date source.
Art. 2 PURCHASE METHODS
The purchase of products takes place by accessing the site and registering.
For each product, a description containing its main features is available on the website. All information provided to assist with purchasing is intended as general information only; it is understood that the image accompanying the product description may not be perfectly representative of its features, but may differ in color, size, products, labels, and packaging. The images are for illustrative purposes only.
Green Soul Cosmetics confirms receipt of the order by sending an automatic email to the email address provided by the customer during registration.
This confirmation message will contain an “order number” to be used in any communication with Green Soul Cosmetics.
The message will contain all the information entered by the customer, who undertakes to verify its accuracy and promptly communicate any corrections. In the event of non-acceptance of the order, Green Soul Cosmetics guarantees prompt notification to the customer.
Art. 3 PAYMENT METHODS
All prices on the site are intended to be retail prices and, therefore, include Value Added Tax (VAT).
Prices may vary without notice and the only correct price is the one indicated at the time of order confirmation.
For certain products subject to price promotions, Green Soul Cosmetics reserves the right to accept orders by reducing the quantity, subject to prior communication and acceptance by the customer. Failure to do so will result in the order being considered cancelled.
PAYMENT TYPES:
- You can choose to pay through the secure NEXI or PAYPAL payment systems , which allow online payments with the highest security standards and protection from cyber fraud. You do not need an account to complete the payment, and you can also use the system with credit cards . The system accepts all major credit cards as well as alternative payment methods such as Apple Pay, Google Pay, etc.
- Additionally, you can pay in three interest-free installments via PayPal, with no additional costs or interest, according to the terms and conditions of PayPal's "Pay in 3 Installments" service.
- For payments by BANK TRANSFER, the goods will be shipped only after we verify the credit to our bank account, generally no earlier than 3-5 business days. Art. 4 DELIVERY METHODS
To ensure accurate and timely delivery, Green Soul Cosmetics only ships with FEDEX and DHL EXPRESS express couriers.
For each order placed, Green Soul Cosmetics will issue a sales receipt or a suitable transport document for the shipped material, which will be followed by the issuance of an invoice within the legal deadlines.
For the issuing of the invoice, the information provided by the customer at the time of ordering will be used.
The customer may request a copy of the invoice or receipt within three months of issue.
Shipping is FREE in Italy for orders of €79.00 or more, and is charged to the customer (€6.90) for orders below that amount. Shipping costs will be added, clearly specified before the order is confirmed and upon final confirmation and validation. For deliveries within the European Community, the cost is €16.90 for orders under €149.00 and free for orders over €149.00.
For shipments to the rest of the world the cost is €49.90 for orders under €290.00.
Upon delivery, the customer is required to check:
a) that the packaging is intact, not damaged, not wet, or in any way altered;
b) that the number of packages corresponds to that indicated in the transport document.
Any damage to the product or packaging, or any discrepancy in the information provided, must be immediately reported to the courier by writing "reservation for inspection" on the courier's proof of delivery.
Once the courier's document has been signed, the customer will not be able to raise any objections regarding the external characteristics of the delivered goods. If the goods currently in storage at the courier's warehouse are not collected within 5 business days due to repeated failure to deliver to the address indicated by the customer when placing the order due to the recipient's absence, the order will be considered final, without prejudice to the possibility of proceeding with a subsequent delivery at the recipient's expense.
DUTIES AND CUSTOMS CHARGES ARE THE RESPONSIBILITY OF THE CUSTOMER ORDERING FROM NON-EUROPEAN COUNTRIES!
Art. 5 WARRANTY
Green Soul Cosmetics does not provide any additional guarantees on its products beyond those provided by the individual manufacturers.
Art. 6 RIGHT OF WITHDRAWAL
Pursuant to Article 52 of the Italian Consumer Code and subject to the exclusions set forth in Article 59 of the same code (see in particular the case of the purchase of clearly personalized goods or the supply of sealed goods that are not suitable for return for hygiene or health protection reasons and were opened after delivery.)
The Buyer has the right, within 14 working days of delivery of the purchased products, to exercise the Right of Withdrawal in accordance with the provisions of law. This right allows the Buyer to return the products received and obtain a refund of the price paid, without penalty and without reason. This right applies to all products on the website www.greensoulcosmetics.com, with the exception of items that do not contain the seal or external plastic, such as makeup, skincare, and haircare products, for hygiene reasons. The Products must be returned with their original packaging, accessories, instructions for use, and anything else supplied with them.
If a buyer makes a purchase on the website www.greensoulcosmetics.com and selects PayPal as the payment method, should the buyer subsequently request a refund for any reason, the refund will not include the fees retained by PayPal, but only the net transaction amount. This is because PayPal will not refund Green Soul SNC, but will retain both the fixed and variable transaction fees. Furthermore, any shipping fees, etc., for any reason and in any form, may be further deducted from this net amount. Only the resulting net amount will be refunded.
To exercise the right of withdrawal pursuant to Article 6, the Buyer and/or the recipient of the Order must complete the appropriate Return Form, which can be downloaded by clicking here! Alternatively, and limited to withdrawal pursuant to Article 6, the Customer may communicate the withdrawal to Green Soul Cosmetics through an explicit declaration (letter sent by registered mail). To comply with the withdrawal deadline, the Buyer must send the Return Form or explicit communication before the applicable withdrawal period expires.
To exercise the Right of Withdrawal, the Customer must send the completed form or explicit communication to Green Soul Cosmetics by registered mail within 14 days.
The return must take place without undue delay and in any case no later than 14 (fourteen) days from the date on which the Buyer communicated his decision to withdraw from the contract.
Once the notification has been sent, the customer must promptly ship the goods to the address provided by Green Soul Cosmetics. Shipping costs and responsibility for the goods during shipment, as required by law, are the responsibility of the customer.
We therefore recommend insuring the products with your chosen courier, taking care to carefully package the goods, where possible placing them in an external box, avoiding damaging the original packaging with adhesive tape, labels, etc.
The product must be returned intact in its original packaging, complete with all its parts and accessories.
In the event of damage during transport during the return process, Green Soul Cosmetics will notify the customer within five working days of receiving the goods, allowing them to file a complaint with the courier used for transport.
Damaged goods will be made available for return, and the return request will be cancelled. Except for any repair costs for confirmed damage, Green Soul Cosmetics will refund the full purchase price within 14 days, and in any case not before receiving the purchased goods, by credit card refund or bank transfer to the account indicated by the customer.
The right of withdrawal is entirely forfeited if the products are returned damaged, incomplete, missing parts, or with damaged packaging.
WITHOUT ANY EXCEPTION we will not refund opened or used packages!
Items that do not contain the seal or external plastic, such as makeup products and also skincare and haircare, cannot be returned for hygiene reasons.
This article provides information on the right of withdrawal pursuant to Art. 47 of Legislative Decree no. 206/2005.
Art. 7 DECLARATIONS AND RESPONSIBILITIES
Green Soul Cosmetics declares and guarantees to consumers that its products meet the quality standards recognized by applicable national and local laws and any other parameters required for retail marketing.
Green Soul Cosmetics will not be liable, directly, indirectly, or otherwise, to consumers or third parties if the products are used in a manner that is not compliant with the product category or for any damage resulting from manufacturing defects not reported within the terms set out in Article 5.
Art. 8 APPLICABLE LAW
This sales contract between the customer and Green Soul Cosmetics is deemed to have been concluded in Italy and is governed by Italian law. Unless otherwise stated, Italian law applies. Any disputes arising from this distance selling contract shall be resolved by the Court of Brescia (BS), to which Green Soul Cosmetics belongs.
Pursuant to Articles 1341 and 1342 of the Italian Civil Code, the Parties, pursuant to the terms and conditions established by these General Conditions of Sale and in particular, the premises and Articles 2, 3, 4, 5, 6, 7 and 8 of this Agreement, specifically declare their consent, without any possible exception.
The Customer also has the option of resolving any disputes relating to purchases of Products, without resorting to court, through the online dispute resolution platform available at the link
